This Privacy Policy describes the data protection practices of Sekha Consulting, LLC d/b/a TeamXP (“TeamXP,” “we,” “us,” or “our”). This Privacy Policy applies to information we collect and use about you when you access or use the TeamXP websites, or other online service that links to or otherwise presents this Privacy Policy to you. We refer to these products and services collectively as the “Services.”

PLEASE READ THIS PRIVACY POLICY CAREFULLY TO UNDERSTAND HOW WE HANDLE YOUR INFORMATION. IF YOU DO NOT AGREE TO THIS PRIVACY POLICY, PLEASE DO NOT USE THE SERVICES.

Information We Collect

We collect information about you through the means discussed below. Please note that we need certain types of information so that we can provide the Services to you. If you do not provide us with such information, or ask us to delete it, you may no longer be able to access or use our Services.

Information You Provide to Us

We collect a variety of information that you provide directly to us. For example, we collect information from you through:

  • The Services you use or processing your orders

  • Requests or questions you submit to us via online forms, email, or otherwise

  • Your participation in TeamXP digital activities

  • Any reviews that you submit about the Services

  • Account registration and administration of your account

  • Uploads or posts to the Services

  • Requests for customer support and technical assistance

Information about you

While parts of the Services may not require you to provide any information that can directly identify you by name (such as if you choose to browse the website without logging in), the specific types of information we collect will depend upon the Services you use, how you use them, and the information you choose to provide. The types of data we may collect directly from you include the following:

  • Email address

  • Name

  • Log-in credentials, if you create a TeamXP Member account

  • Billing information, such as shipping address, credit or debit card number, verification number, zip code, and expiration date

  • Phone number, if you choose to provide it

  • Information about purchases or other transactions with us

  • Information about your customer service interactions with us

  • User-generated content you provide to us, such as when you comment on content on the Services, respond to a survey request, review a product, or participate in digital activities across the platform

  • Products in which you enroll

  • Any other information you choose to directly provide to us in connection with your use of the Services

Information about others

We do not collect PII (personally identifiable information) of the non-account owners who participate in digital activities across the platform. Anonymous user interaction data is collected as a result of participation in digital activities across the TeamXP platform.

Information We Collect Through Automated Means

When you use our Services, we collect certain information as described in this Section. As discussed further below, we and our service providers (which are third-party companies that work on our behalf) may use a variety of technologies, including cookies and similar tools, to assist in collecting this information.

Websites

When you use our website, we collect and analyze information such as your IP address, browser types, browser language, operating system, software, and hardware attributes (including device IDs) referring and exit pages and URLs, the number of clicks, pages viewed and the order of those pages, date and time of use, content watched, total minutes watched, error logs, and other similar information about how you use the website.

Location Information

When you use the Services, we and our service providers may automatically collect general location information (e.g., IP address, city/state, and/or postal code associated with an IP address, city/state) from your computer or mobile device.

How We Use Your Information

We, or our service providers, use and process your information for various purposes depending on the types of information we have collected from and about you, to:

  • Provide the Services

    • Complete a purchase or provide the Services you have requested, including invoicing and accounting

  • Communicate with you and provide support

    • Respond to your request for information and provide you with more effective and efficient customer service

    • Provide you with updates and information about products in which you have enrolled

  • Research and development. We use your personal information for research and development purposes, including to analyze and improve the Service and our business in an informed way. As part of these activities, we may create aggregated, de-identified, and/or anonymized data from the personal information we collect. We make personal information into de-identified or anonymized data by removing information that makes the data personally identifiable to you. We may use this aggregated, de-identified, or otherwise anonymized data and share it with third parties for our lawful business purposes, including to analyze, improve, and promote the Service and our business.

  • Marketing and content customization

    • Contact you by email, postal mail, or phone regarding TeamXP and third-party products, services, surveys, research studies, promotions, special events and other subjects that we think may be of interest to you

    • Customize the advertising and content you see on the Services

  • Business operations

    • Help us better understand your interests and needs, and improve the Services, including through research and reports, and test and create new products, features, and services

    • Secure our websites and applications, and resolve app crashes and other issues being reported

  • Legal Purposes

    • Comply with any procedures, laws, and regulations that apply to us where it is necessary for our legitimate interests or the legitimate interests of others

    • Establish, exercise, or defend our legal rights where it is necessary for our legitimate interests or the legitimate interests of others

 Combined Information

For the purposes discussed in this Privacy Policy, we may combine the information that we collect through the Services with information that we receive from other sources, both online and offline, and use such combined information in accordance with this Privacy Policy.

 

Cookies and Similar Technologies

To collect the information in the “Information We Collect Through Automated Means” section above, we and our service providers use Internet server logs, local storage, cookies, tracking pixels, and other similar tracking technologies (collectively, "cookies"). We use these technologies to offer you a more tailored experience in the future, by understanding and remembering your particular browsing preferences. Cookies are small text files that are placed on your computer or mobile device when you visit a site that enable us to: (i) recognize your computer; (ii) store your preferences and settings; (iii) understand the web pages of the Services you have visited; (iv) enhance your user experience by delivering and measuring the effectiveness of content and advertising tailored to your interests; (v) perform searches and analytics; and (vi) assist with security and administrative functions.

We may also gather information through other methods as we adopt additional technologies. Please note that you can change your settings to notify you when a cookie is being set or updated or to block cookies altogether. Online Analytics and Advertising

1. Analytics

We may use third-party web analytics services (such as those of Google Analytics) on our Services to collect and analyze usage information through cookies and similar tools; engage in auditing, research, or reporting; assist with fraud prevention; and provide certain features to you. To prevent Google Analytics from using your information for analytics, you may install the Google Analytics Opt-out Browser Add-on by clicking here.

If you receive email from us, we may use certain analytics tools, such as clear GIFs to capture data such as when you open our message or click on any links or banners our email contains. This data allows us to gauge the effectiveness of our communications and marketing campaigns.

2. Online Advertising

The Services may integrate third-party advertising technologies that allow for the delivery of relevant content and advertising on the Services, as well as on other websites you visit and other applications you use. The ads may be based on various factors such as the content of the page you are visiting, the information you enter such as your age and gender, your searches, demographic data, user-generated content, and other information we collect from you. These ads may be based on your current activity or your activity over time and across other websites and online services and may be tailored to your interests.

Third parties may also place cookies or other tracking technologies on your computer, mobile phone, or other device to collect information about you as discussed above, including your email address. These third parties (e.g., ad networks and ad servers such as Google, Meta, and others) may also serve tailored ads to you as you use the Internet and Internet-connected applications, and access their own cookies or other tracking technologies on your computer, mobile phone, or other device you use to access the Services to assist in this activity.

We neither have access to, nor does this Privacy Policy govern, the use of cookies or other tracking technologies that may be placed on your device you use to access the Services by such non-affiliated third parties. If you are interested in more information about tailored browser advertising and how you can generally control cookies from being put on your computer to deliver tailored advertising, you may visit the Network Advertising Initiative’s Consumer Opt-Out link, the Digital Advertising Alliance’s Consumer Opt-Out link, or Your Online Choices to opt-out of receiving tailored advertising from companies that participate in those programs. To opt out of Google Analytics for display advertising or customize Google display network ads, visit the Google Ads Settings page. We do not control these opt-out links or whether any particular company chooses to participate in these opt-out programs. We are not responsible for any choices you make using these mechanisms or the continued availability or accuracy of these mechanisms. Please note that if you exercise the choices above, you will still see advertising when you use the Services, but it will not be tailored to you based on your online behavior over time.

3. Notice Concerning Do Not Track

Do Not Track (“DNT”) is a privacy preference that users can set in certain web browsers. We are committed to providing you with meaningful choices about the information collected on our website for third party purposes, and that is why we provide the variety of opt-out mechanisms listed above. However, we do not currently recognize or respond to browser-initiated DNT signals. To learn more about Do Not Track, you can do so here. Please note that Do Not Track is a different privacy mechanism than the user “preference signal” referenced in the “Your Rights and Choices” section below, which is a browser-based control that indicates whether you would like to opt out of processing of your information for certain purposes, such as the “sale” of your information or the disclosure of your information for targeted advertising purposes, under applicable laws.

How We Share Your Information

We may share your personal information with the following categories of recipients and as otherwise described in this Privacy Policy or at the time of collection.

  • Your Service account administrator.  Information associated with the Service, including your contact data, account data, and past use of your account may become accessible to your organization’s TeamXP administrators.  

  • Service providers. Third parties that provide services on our behalf or help us operate the Service or our business (such as business applications, cloud hosting and infrastructure, content delivery network, information technology, customer support, customer relationship management, VOIP phone, email delivery, marketing, advertising, payment processing, chatbot, session replay, generative artificial intelligence, call recording/transcription, customer research, and analytics).

  • Authentication services. When you log into the Service by using your credentials on a third party service, such as Google, that service may collect your credentials and other data to facilitate the authentication.  See the service’s relevant settings or privacy policy for details.  You can read Google’s privacy policy here: https://policies.google.com/privacy

  • Payment processors. Third party payment processors, such as SquareSpace Payments, that collect your payment card data, banking details, and/or other transaction data to process your payments for the Service. You can find SquareSpace’s privacy policy here: https://www.squarespace.com/privacy 

  • Affiliates. Our parent company and other corporate affiliates that we control, are controlled by, or with which we are under common control, for purposes consistent with this Privacy Policy.

  • Professional advisors. Professional advisors, such as lawyers, auditors, bankers, and insurers, where necessary in the course of the professional services that they render to us.

  • Authorities and others. Law enforcement, government authorities, and private parties, as we believe in good faith to be necessary or appropriate for the compliance and protection purposes described above.

  • Business transferees. Parties (and their advisors) to transactions (or negotiations of or due diligence for such transactions) involving a corporate divestiture, merger, consolidation, acquisition, reorganization, sale or other disposition of all or any portion of the business or assets of, or equity interests in, TeamXP or our affiliates (including, in connection with a bankruptcy or similar proceedings).

Retention of Your Information

We keep your information for no longer than necessary for the purposes for which it is processed. The length of time for which we retain information depends on the purposes for which we collect and use it and/or as required to comply with applicable laws.

How We Protect Your Information

TeamXP takes technical and organizational security measures to protect the information provided via the Services from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. However, no Internet or email transmission is ever fully secure or error-free. Please keep this in mind when disclosing any information to TeamXP via the Internet.

 

Third-Party Links and Features

The Services contain links to third-party websites such as social media sites, and also contain third-party plug-ins (such as the Facebook “like” button and Twitter “follow” button). If you choose to use these sites or features, you may disclose your information not just to those third-parties, but also to their users and the public more generally depending on how their services function. We are not responsible for the content or practices of those websites or services. The collection, use, and disclosure of your information will be subject to the privacy policies of the third-party websites or services, and not this Privacy Policy. We urge you to read the privacy and security policies of these third parties.

Children's Privacy

The Services are intended for general audiences and not for children under the age of 13. If we become aware that we have inadvertently collected “personal information” (as defined by the United States Children’s Online Privacy Protection Act) from children under the age of 13 without valid parental consent, we will take reasonable steps to delete it as soon as possible. We do not knowingly process data of EU residents under the age of 16 without parental consent. If we become aware that we have collected data from an EU resident under the age of 16 without parental consent, we will take reasonable steps to delete it as soon as possible. We also comply with other age restrictions and requirements in accordance with applicable local laws.

Your choices

Your choices regarding the personal information we hold about you include the following:

  • Access or update your information. You may review and update certain Service account information in your settings.

  • Opt-out of marketing communications. You may opt out of marketing emails at any time by following the opt-out or unsubscribe instructions in the email. You may opt out of our marketing communications via mail or phone by contacting us with your request or by telling the caller you wish to opt out.  Please note that if you opt out of marketing emails, you may continue to receive service-related and other non-marketing emails.

  • Change browser settings. Most browsers let you reject cookies, clear cookies, and browser web storage, prevent pixels/clear gifs from loading, and block javascript software code. To do this, follow the instructions in your browser settings. Disabling these technologies may prevent Service features from working.  For more information about your choices regarding cookies and other technologies, see our Cookie Notice.

  • Do Not Track. Some Internet browsers may be configured to send “Do Not Track” signals to the online services that you visit. We currently do not respond to “Do Not Track” signals. To find out more about “Do Not Track,” please visit http://www.allaboutdnt.com.

Authentication services.  You may be able to limit the information shared with us by third-party services that you use to sign in to the Service, such as Google. See your settings and the privacy policy for that service for details. 

 

Legal Bases for Use of Your Information

The legal bases for using your information as set out in this Privacy Policy are as follows:

  • Where use of your information is necessary to perform our obligations under a contract with you (for example, to comply with: the terms of service of our websites which you accept by browsing the websites/registering; and/or our contract to provide our Services to you);

  • Where use of your information is necessary for our legitimate interests or the legitimate interests of others (for example, to provide security for our website and applications; operate our business and our Services; make and receive payments; comply with legal requirements and defend our legal rights; prevent fraud and to know the customer to whom we are providing Services);

  • Where we are required to process information in accordance with an EU Member State legal obligation; or

  • Where we have your consent, in accordance with applicable law.

 

Changes to our Privacy Policy

We reserve the right to amend this Privacy Policy at any time to reflect changes in the law, our data collection and use practices, the features of our Services, or advances in technology. We will make the revised Privacy Policy accessible through the Services, so you should review the Privacy Policy periodically. You can know if the Privacy Policy has changed since the last time you reviewed it by checking the “Date of Last Revision" included at the beginning of the document. If we make a material change to the Policy, you will be provided with appropriate notice in accordance with legal requirements. By continuing to use the Services, you are confirming that you have read and understood the latest version of this Privacy Policy.

Retention. We retain personal information for as long as necessary to fulfill the purposes for which we collected it, including for the purposes of satisfying any legal, accounting, or reporting requirements, to establish or defend legal claims, or for the compliance and protection purposes described above.  Factors determining the appropriate retention period for personal information include the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of personal information, the purposes for which we process the personal information, whether we can achieve those purposes through other means, and the applicable legal requirements. 

When we no longer require the personal information we have collected about you, we will either delete or anonymize it (so that it is no longer personally identifiable with you) or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will isolate your personal information from any further processing, employing security safeguards designed to protect it, until deletion is possible.

Use for new purposes. We may use your personal information for reasons not described in this Privacy Policy where permitted by law and the reason is compatible with the purpose for which we collected it. If we need to use your personal information for an unrelated purpose, we will notify you and explain the applicable legal basis.

Sensitive personal information. We do not require sensitive personal information (e.g., information related to racial or ethnic origin, political opinions, religion or other beliefs, health, biometrics or genetic characteristics, criminal background, or trade union membership) and ask that you do not provide us with any such information.

  • Right of access. You can ask us to provide you with information about our processing of your personal information and give you access to your personal information.

  • Right to rectification. If the personal information we hold about you is inaccurate or incomplete, you are entitled to request to have it rectified.

  • Right to erasure. You can ask us to delete or remove your personal information where there is no lawful reason for us to continue to store or process it, where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your personal information to comply with local law.

    • if you want us to establish the information’s accuracy;

    • where our use of the information proves to be unlawful, but you do not want us to erase it;

    • where you need us to hold the information even if we no longer require it as you need it to establish, exercise or defend legal claims; or

    • if you have objected to our use of your information but we need to verify whether we have overriding legitimate grounds to use it.

  • Right to object. You can object to our processing of your personal information where we are relying on a legitimate interest (or those of a third party) to do so and you believe it impacts your fundamental rights and freedoms. You also have the right to object where we are processing your personal information for direct marketing purposes.

  • Right to data portability. You have the right, in certain circumstances, to ask us to provide to you, or a third party you have chosen, your personal information in a structured, commonly used, machine-readable format. 

  • Right to withdraw consent at any time. Where we are relying on consent to process your personal information you have the right to withdraw your consent at any time. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent.

Exercising those rights. Please note that some of these rights may be limited where we have an overriding interest or legal obligation to continue to process the personal information or where certain exemptions apply. If we decline your request, we will tell you why, subject to legal restrictions.

Your right to lodge a complaint with your supervisory authority. If you are not satisfied with our response to a request you make, or how we process your personal information, you can make a complaint to the data protection regulator in your habitual place of residence.

International data transfers. We are headquartered in the United States and may use service providers that operate in the United States and other countries. Therefore, we may transfer your personal information to recipients outside of Europe. Some of these recipients are in countries which have been formally recognized as providing an adequate level of protection for personal information by the European Commission and Secretary of State in the UK, in which case, we rely on the relevant "adequacy decisions".  

Where the transfer is not subject to an adequacy decision or regulations, we take appropriate safeguards to ensure your personal information remains protected in accordance with this Privacy Policy and applicable laws by entering into appropriate data transfer mechanism permitted under Article 46 of the GDPR / UK GDPR (as applicable), such as the European Commission's Standard Contractual Clauses or the UK International Data Transfer Addendum (as applicable).
